PhotoQuo™ respects your privacy. This Privacy Policy explains what information PhotoQuo™ collects, how we use and protect it, when it may be shared, and the choices available to you.

This Privacy Policy applies to the PhotoQuo™ mobile applications, the photoquo.com website, and related services (collectively, the "Service").

PhotoQuo™ is operated by BigWindow LLC ("PhotoQuo™," "we," "us," or "our").

1. Our Approach to Privacy

PhotoQuo™ is designed as a private daily photo diary with optional sharing among a limited number of mutually accepted friends.

PhotoQuo™ does not provide public user profiles, a public photo feed, public photo sharing, or a searchable user directory.

Your photographs are not made publicly available by PhotoQuo™.

If you choose to add friends, certain recent photographs and related information may be shared with those friends according to the sharing rules of the Service.

2. Information We Collect

We collect information necessary to create accounts, operate PhotoQuo™, store your photographs, provide optional friend sharing, maintain security, and improve the Service.

The information we collect may include the following categories.

Account Information

When you create or maintain a PhotoQuo™ account, we may collect:

• your display name;
• email address;
• authentication and account-security information;
• account identifier;
• account status;
• account tier;
• timezone; and
• account creation and modification dates.

Passwords are not intended to be stored in readable form. Password credentials are processed and stored using appropriate cryptographic protection.

Photos and Captions

When you use PhotoQuo™, we may collect and store:

• the composite photographs you choose to save;
• photo capture date and time;
• captions you add to photographs;
• thumbnail versions of photographs;
• information necessary to organize and display your photo history; and
• technical metadata associated with stored photographs.

PhotoQuo™ stores the completed composite photograph used by the Service rather than retaining the separate original camera images used to create the composite, where the Service operates as designed.

Location Information

Location information is optional.

If you permit PhotoQuo™ to access your device location when taking a photograph, we may collect:

• latitude and longitude;
• locality or city;
• administrative region or state;
• country code; and
• related location information associated with the photograph.

Location information may be obtained from your device and processed using device or third-party geocoding services.

If location information is unavailable, you deny location permission, or location processing fails, you can still use PhotoQuo™.

Precise geographic coordinates are treated as private information and are not automatically displayed to friends.

Friend and Invitation Information

If you use PhotoQuo™'s friend features, we may collect:

• friend relationships;
• friend invitation information;
• invitation tokens and status;
• dates invitations were created, accepted, declined, or expired;
• information necessary to enforce friend limits; and
• information necessary to determine whether a friend may currently view a photograph.

PhotoQuo™ does not provide a searchable directory of users.

PhotoQuo™ does not require uploading your address book or contacts to find friends. Invitations may instead be shared using your device's normal sharing capabilities.

When you use your device's share function, the applications or services you choose for sending an invitation may process information according to their own privacy policies.

Reactions and Social Activity

Where reaction features are available, we may collect:

• the reaction you submit to a friend's photograph;
• the photograph associated with the reaction;
• the account that submitted the reaction; and
• the date and time of the reaction.

Photo owners may retain information about reactions received on their photographs even after the photograph is no longer available for current friend viewing, subject to PhotoQuo™'s retention and account-deletion rules.

Purchase Information

If you purchase a PhotoQuo™ upgrade, we may receive information necessary to verify and maintain the purchase, such as:

• purchase platform;
• transaction or purchase identifier;
• verification status; and
• information necessary to restore a previous purchase.

Payments made through Apple or Google are processed by the applicable app store.

PhotoQuo™ does not need to receive or store your complete credit-card number for purchases processed through those stores.

Device and Technical Information

When you use PhotoQuo™, we may automatically receive limited technical information necessary to operate and secure the Service, which may include:

• device and operating-system information;
• application version;
• IP address;
• request timestamps;
• server and application logs;
• authentication and session information;
• error and diagnostic information; and
• information relating to failed or successful network requests.

We may use this information to operate the Service, diagnose problems, prevent abuse, and maintain security.

3. Information We Do Not Intentionally Collect

PhotoQuo™ is not designed to collect information merely for advertising or user profiling.

In particular:

• PhotoQuo™ does not provide a public user directory.
• PhotoQuo™ does not make your photographs publicly available.
• PhotoQuo™ does not require access to your contacts to find friends.
• PhotoQuo™ does not sell your personal information.
• PhotoQuo™ does not sell your photographs.
• PhotoQuo™ does not use your private photographs for advertising.

If these practices change materially, this Privacy Policy will be updated before the new practice is implemented where required by applicable law.

4. How We Use Information

We use information collected through PhotoQuo™ to:

• create and maintain your account;
• authenticate you;
• provide and secure the Service;
• store and display your photographs and photo history;
• process photographs and create thumbnails;
• associate photographs with the correct local calendar date;
• provide optional location information;
• enable invitations and friendships;
• provide optional sharing with accepted friends;
• determine whether a friend remains authorized to view a photograph;
• process reactions where available;
• enforce free and upgraded account limits;
• verify and restore purchases;
• process account settings;
• provide pause and resume functionality;
• respond to support requests;
• diagnose technical problems;
• prevent fraud, abuse, and unauthorized access;
• enforce the PhotoQuo™ Terms of Service;
• comply with applicable legal requirements; and
• maintain and improve the reliability and security of PhotoQuo™.

We do not use your photographs to create advertising profiles.

5. How Friend Sharing Works

Friend sharing is optional.

You may use PhotoQuo™ as a private photo diary without adding any friends.

When you establish a friendship with another PhotoQuo™ user, that person may be permitted to view your currently eligible shared photograph according to PhotoQuo™'s sharing rules.

Friend access is limited. Friends do not receive unrestricted access to your historical photo diary.

PhotoQuo™ may limit friend visibility based on factors such as:

• whether the friendship remains active;
• whether either account is paused;
• the age of the photograph; and
• whether a newer eligible photograph is available.

Removing a friend ends that person's future PhotoQuo™ access to content that requires the friendship.

A person who has already viewed a photograph may be able to preserve it independently, including by taking a screenshot or photograph of their screen. PhotoQuo™ cannot control copies created outside the Service by another user.

6. Location Privacy

Location collection is optional.

PhotoQuo™ may store precise geographic coordinates associated with your photograph when you have granted the necessary device permission and valid location information is available.

PhotoQuo™ may also convert coordinates into broader location information such as city, state or region, and country.

Precise coordinates are not automatically shared with friends.

If location information is displayed to friends, PhotoQuo™ is intended to use only the broader location information permitted by the Service rather than your precise geographic coordinates.

You may control PhotoQuo™'s access to device location through your mobile device settings.

Disabling location access does not prevent you from taking and storing PhotoQuo™ photographs.

7. How We Share Information

We do not sell your personal information.

We may disclose information in the following limited circumstances.

With Your Friends

If you choose to establish friendships through PhotoQuo™, we may display information permitted by the Service to your accepted friends.

This may include:

• your display name;
• your currently eligible shared photograph;
• its caption;
• broad location information where applicable;
• your paused status; and
• other limited information necessary for the friend-sharing features.

Precise geographic coordinates are not automatically shared with friends.

With Service Providers

We may use companies or service providers to help operate PhotoQuo™.

These providers may perform functions such as:

• server or infrastructure hosting;
• data storage and backup;
• email or communications delivery;
• geocoding or location processing;
• security and fraud prevention;
• error reporting and diagnostics;
• purchase verification; or
• content moderation.

Service providers may receive information only as reasonably necessary to perform services for PhotoQuo™ and are expected to handle that information appropriately.

For Legal and Safety Reasons

We may preserve or disclose information if we reasonably believe doing so is necessary to:

• comply with applicable law, regulation, subpoena, court order, or other valid legal process;
• respond to lawful requests from government authorities;
• investigate fraud, abuse, security incidents, or violations of our Terms;
• protect the rights, property, or safety of PhotoQuo™, our users, or others; or
• establish, exercise, or defend legal claims.

Business Transfers

If PhotoQuo™ or BigWindow LLC is involved in a merger, acquisition, financing, reorganization, sale of assets, or similar business transaction, information associated with the Service may be transferred as part of that transaction.

Any successor would remain subject to applicable privacy obligations concerning the transferred information.

8. Photo Retention

Photo retention depends on the features and account tier associated with your account.

Free accounts may retain photographs for a limited period. When a photograph exceeds the applicable retention period, it may be permanently deleted.

Paid or upgraded accounts may provide longer or unlimited history retention while the Service remains available, subject to these Terms and this Privacy Policy.

Purchasing an upgrade does not restore photographs that were already permanently deleted under a previous retention limit.

You may also delete individual photographs.

When a photograph is permanently deleted, we will remove it from active PhotoQuo™ systems according to our normal deletion processes, although temporary backup or system copies may persist for a limited period before being overwritten or deleted.

PhotoQuo™ is not a guaranteed backup or permanent archival service.

9. Account Deletion

Where account deletion is available, you may request permanent deletion of your PhotoQuo™ account.

Account deletion may remove:

• your account information;
• retained photographs;
• captions;
• friendships;
• pending invitations;
• location information associated with your photographs; and
• other information associated with your account.

Deletion is permanent and deleted photographs and account information may not be recoverable.

Some limited information may be retained when reasonably necessary or legally required for purposes such as:

• fraud prevention;
• security;
• financial and purchase records;
• legal compliance;
• resolving disputes; or
• enforcing our agreements.

Information that forms part of another user's legitimate account history, such as a record that a reaction was received, may be retained in de-identified or limited form where appropriate.

Deletion from backup systems may take additional time as backups are rotated or overwritten.

10. Security

We use reasonable administrative, technical, and organizational measures intended to protect information handled by PhotoQuo™.

These measures may include:

• encrypted network communications;
• protected authentication credentials;
• access controls;
• secure session management;
• restricted server and database access; and
• logging and monitoring intended to identify operational or security problems.

No method of electronic transmission, storage, or security is completely secure.

Accordingly, we cannot guarantee that unauthorized access, disclosure, alteration, loss, or destruction of information will never occur.

You are responsible for protecting your account credentials and for maintaining appropriate security on devices you use to access PhotoQuo™.

11. Content Moderation

PhotoQuo™ prohibits certain content as described in the Terms of Service, including nudity and sexually explicit material.

PhotoQuo™ may use automated systems, service providers, or manual processes to identify content that may violate those rules.

If automated content moderation is used, photographs or information derived from photographs may be processed for the purpose of determining whether content complies with PhotoQuo™ policies.

Content moderation systems are not guaranteed to identify every violation and may occasionally classify content incorrectly.

Information processed for moderation is not used by PhotoQuo™ for advertising.

12. Cookies and Web Sessions

The PhotoQuo™ website may use cookies or similar technologies necessary to:

• authenticate users;
• maintain secure sessions;
• protect against unauthorized requests;
• remember necessary session state; and
• operate the website.

PhotoQuo™ may use an opaque session identifier stored in a secure browser cookie to maintain an authenticated web session.

We do not need to use advertising cookies to provide PhotoQuo™.

If analytics or other non-essential cookies are introduced in the future, this Privacy Policy and any legally required consent mechanisms will be updated accordingly.

13. Children's Privacy

PhotoQuo™ is intended for users age 13 and older.

We do not knowingly collect personal information from children under age 13. If we learn that we have collected personal information from a child under age 13, we will take reasonable steps to delete the information and associated account.

A parent or guardian who believes that a child under age 13 has provided personal information to PhotoQuo™ may contact us using the information below.

14. Your Choices

Depending on the features available in PhotoQuo™, you may be able to:

• update your display name;
• update your email address;
• change your password;
• control device location permission;
• add or remove friends;
• decline friend invitations;
• pause or resume your account;
• delete individual photographs;
• access your retained photo history;
• export your data where that feature is available; and
• permanently delete your account where that feature is available.

Some privacy controls are also available through your mobile device's operating-system settings.

15. Data Export

Where PhotoQuo™ provides data export, you may request a copy of certain information associated with your account.

An export may include retained photographs and related account information.

Export functionality does not necessarily include information that PhotoQuo™ is legally prohibited from providing or information belonging to another person.

16. International Processing

PhotoQuo™ is operated from the United States.

If you use PhotoQuo™ from another country, your information may be transmitted to, stored in, or processed in the United States or other locations where PhotoQuo™'s service providers operate.

Privacy and data-protection laws in those locations may differ from those in your country.

Where required, we will use appropriate mechanisms for international transfers of personal information.

17. Third-Party Services

PhotoQuo™ may interact with services provided by third parties, including:

• Apple;
• Google;
• mobile operating-system services;
• app stores;
• hosting and infrastructure providers;
• geocoding or location providers; and
• communications applications you choose when sharing an invitation.

Those third parties may collect or process information independently under their own privacy policies.

PhotoQuo™ is not responsible for the privacy practices of services that we do not control.

18. Do Not Sell or Share Personal Information for Advertising

PhotoQuo™ does not sell personal information.

PhotoQuo™ does not sell your photographs.

PhotoQuo™ does not share your personal information with third parties for cross-context behavioral advertising.

PhotoQuo™ does not use your private photographs to target advertising to you.

If our practices change in a manner that creates additional rights under applicable privacy laws, we will update this Privacy Policy and provide required choices before applying those practices.

19. Privacy Rights

Depending on where you live, applicable law may provide rights concerning your personal information.

These rights may include the ability to request:

• access to personal information;
• correction of inaccurate information;
• deletion of information;
• a copy or portable version of information;
• information about how personal information is used or disclosed; or
• restriction of or objection to certain processing.

Some rights are subject to exceptions and verification requirements.

We will not discriminate against you for exercising privacy rights provided by applicable law.

Many requests can be accomplished directly through PhotoQuo™ account controls when the applicable functionality is available.

20. Changes to This Privacy Policy

We may update this Privacy Policy as PhotoQuo™ changes or as necessary to address legal, regulatory, security, or operational requirements.

When we make changes, we will update the "Last Updated" date at the top of this Policy.

If changes materially affect how we collect, use, or share personal information, we will provide additional notice where reasonably appropriate or legally required.
